Welcome to ASCE Performance. These Terms & Liability Disclaimer (“Terms”) govern your access to and use of our website, coaching programs, and services (collectively, the “Services”). By accessing, purchasing, or using our Services—including checking a box or clicking “I agree”—you provide your explicit consent to these Terms. If you do not agree, do not use our Services.

1. Acceptance of Terms

By enrolling in or using ASCE Performance Services, you confirm that:

  • You have read, understood, and accept these Terms.

  • You are at least 18 years old (or have parental/guardian consent if under 18).

  • You agree to comply with all applicable laws while using the Services.

  • You acknowledge and accept the Liability Disclaimer below.

2. Nature of Services

  • ASCE Performance provides educational, instructional, and coaching services related to exercise, rehabilitation, and physical performance.

  • I am not a licensed medical practitioner, physiotherapist, or healthcare professional. I do not provide medical advice, diagnosis, or treatment.

  • The Services are for informational and educational purposes only and are not a substitute for professional medical care. You should always consult a licensed healthcare provider before starting any exercise or rehab program.

  • No Guarantees: ASCE Performance makes no guarantees regarding outcomes, recovery timelines, pain reduction, or performance improvements. Results vary between individuals and depend on many factors outside our control.

3. Assumption of Risk

By participating in any coaching session or program, you agree that:

  • You understand that physical activity, rehabilitation exercises, and similar programs carry a risk of injury, aggravation of pre-existing conditions, or other health complications.

  • You voluntarily assume all such risks.

  • You are solely responsible for monitoring your own health, stopping any exercise that causes pain, discomfort, dizziness, numbness, shortness of breath, or any concerning symptoms, and seeking professional medical advice when necessary.

4. Account Registration & Security

  • You agree to provide accurate and current information.

  • Keep login credentials confidential.

  • Notify ASCE Performance of any unauthorized account use within 48 hours.

  • You are responsible for all activity under your account.

5. Fees, Payments & Refunds

  • Fees are listed at checkout and are non-refundable unless explicitly stated.

  • Payment plans may auto-renew unless canceled prior to the next billing cycle.

  • ASCE Performance may adjust fees or plans with reasonable notice.

6. Intellectual Property

  • All content, materials, and branding (videos, guides, images, logos, text) are owned by ASCE Performance or its licensors.

  • Use is limited to personal, non-commercial purposes.

  • Reproduction, distribution, or public display without written consent is prohibited.

7. User Conduct

You agree not to:

  • Use Services for illegal or harmful purposes

  • Post offensive, defamatory, or inappropriate content

  • Reverse-engineer, copy, or misuse materials or the platform

  • Share accounts with unauthorized users

Violations may result in suspension or termination of access.

8. Privacy & Data

Your use of Services is subject to our Privacy Policy, which explains how personal data—including health information—is collected, used, and protected.

GDPR and other applicable privacy laws may apply depending on your location.

9. Limitation of Liability & Indemnification

To the fullest extent permitted by law:

  • ASCE Performance, its founder, and affiliates are not responsible for any injury, illness, or aggravation of pre-existing conditions, nor for any loss, damages, or dissatisfaction arising from use of Services.

  • You agree to indemnify and hold harmless ASCE Performance and its affiliates from any claims arising from your participation in Services.

  • Nothing in these Terms excludes liability for gross negligence or willful misconduct under applicable law.

10. Governing Law & Dispute Resolution

  • These Terms are governed by Belgian law.

  • Disputes will first be attempted to resolve through negotiation.

  • If unresolved, disputes may be submitted to binding arbitration under Belgian arbitration rules.

  • Courts in Brussels, Belgium have exclusive jurisdiction if arbitration is not applicable.

  • Note: If you are accessing Services from outside Belgium, your local laws may also apply.

11. Acknowledgment

By using ASCE Performance Services, you confirm that:

  • You understand the non-medical nature of the Services.

  • You voluntarily accept the risks associated with participation.

  • You have read and agreed to these Terms & Liability Disclaimer.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
