These Terms govern the sale of our self-guided digital products through our websites and our Shopify store, including thebulletproofkneeprotocol.com, bulletproofaclprotocol.com, aclfreetraining.com and asce-performance.com.

One-to-one and group coaching are sold separately and are governed by their own terms. These Terms do not apply to them.

Our Privacy and Cookie Policy explains how we handle your personal information and forms part of your agreement with us.

1. ACCEPTANCE

1.1 These Terms are a binding agreement between you and ASCE.PERFORMANCE BV. By purchasing, you accept them.

1.2 Acceptance is a condition of purchase. Before payment can be taken you must tick the confirmation set out in Annex A. It is presented unticked and the payment button stays disabled until you tick it. There is no route to our products that bypasses it. We record the date, time and version of the Terms accepted.

1.3 If payment is somehow taken from someone who has not given that confirmation, no contract is formed, no access is granted, and we refund in full.

1.4 You must be at least 18 years old.

1.5 Changes. We may amend these Terms. The version in force when you order governs that order.

1.6 Language. These Terms are provided in English and the English version governs. Our registered seat is in the Dutch-language region of Belgium; if you are a consumer resident in Belgium you may write to us in Dutch, French or German and we will reply in that language.

2. WHAT YOU ARE BUYING — AND WHAT IT IS NOT

Please read this section in full. It defines the nature of what you are buying.

2.1 Performance coaching, delivered as education. ASCE Performance provides performance coaching: educational and instructional material in physical training, conditioning and athletic performance. Our self-guided products are structured programmes of video, written material, guides and tracking tools that you follow on your own.

2.2 We are not healthcare providers. Neither ASCE Performance nor Alan Salgado Espino nor anyone working with us is a licensed physician, surgeon, physiotherapist or kinesitherapist (kinesitherapeut / kinésithérapeute), osteopath, chiropractor, nurse, dietitian or psychologist, or a healthcare professional within the meaning of the Belgian Coordinated Act of 10 May 2015 on the practice of healthcare professions or the equivalent law of your country.

2.3 No medical services. We do not provide medical advice, diagnosis, prognosis, treatment, therapy, clinical rehabilitation, injury assessment for clinical purposes, return-to-sport clearance or prescription. Nothing we sell is a medical device or a medical treatment.

2.4 Not a substitute for medical care. Our products are not a substitute for consultation with, examination by, or treatment from a licensed healthcare professional who has physically assessed you. Never disregard, delay or discontinue professional medical advice because of anything you read or watch in our products.

2.5 General content, not personal prescription. Our products are made for a general audience. They are not adapted to your medical history, imaging, surgical history, healing timeline, other conditions or medication. Nobody assesses you, and nobody supervises you.

2.6 Terminology. Where our marketing or content uses words such as "rehab", "recovery", "protocol", "assessment", "criteria", "clearance" or "readiness", those words are used in a non-clinical, training and educational sense only. They do not denote a medical, physiotherapeutic or clinical service and do not imply that any act reserved to a regulated health profession is being performed.

2.7 Get medical clearance first. You must obtain clearance from a licensed healthcare professional before beginning. This is essential if any of the following applies: you have had surgery to the knee, hip, ankle, foot or spine; you have a current or suspected injury, tear, fracture or tendinopathy; you have arthritis or a degenerative joint condition; you have a cardiovascular, respiratory, metabolic, neurological or musculoskeletal condition; you are pregnant or post-partum; you take medication affecting balance, blood pressure, heart rate, pain perception or connective tissue; you are under medical care for any condition; or you are over 65 or have been sedentary for a long period.

2.8 No guaranteed outcome. We make no guarantee or promise about results, pain reduction, healing, strength, range of motion, stability, return to sport, recovery timeline, prevention of injury or re-injury, or avoidance of surgery. Individual results vary and may differ materially from any testimonial or example in our marketing.

2.9 Testimonials. Any testimonial or case study shown is that individual's genuine experience at that time. It is not a promise, a projection or a typical result. We do not publish incentivised or fabricated reviews, and we take reasonable steps to verify that reviews come from people who actually used the product. Where someone shown has received any benefit or commission, we say so alongside.

3. RISK, AND WHAT YOU ARE RESPONSIBLE FOR

3.1 The risks are real. Physical training carries inherent and unavoidable risks, including: muscle strain and tear; ligament and tendon injury or re-injury; meniscal or cartilage injury; sprain, dislocation or subluxation; fracture; graft failure or laxity after ligament reconstruction; swelling; aggravation of any pre-existing condition; falls; cardiovascular events; fainting; and, rarely, permanent disability or death.

3.2 You assume those risks. Your participation is voluntary. You take part knowing these risks and you knowingly and voluntarily assume them, whether known or unknown, except where harm results from our own gross negligence, wilful misconduct, or fault causing death or personal injury (see Section 8.3).

3.3 You confirm that. Each time you use our products you confirm that you have obtained medical clearance or knowingly decided not to, that you are not aware of any medical reason not to participate, and that anything you have told us about your health is true and complete.

3.4 While you train, you will.

(a) Stop immediately and seek medical attention if you feel pain beyond ordinary training discomfort, sharp or catching pain, giving way or instability, swelling, locking, numbness, dizziness, faintness, chest pain, shortness of breath or anything that concerns you. (b) Not progress to a later phase, heavier load or higher-impact movement until you genuinely meet the criteria we set. (c) Use suitable equipment, footwear and a safe, clear training space. (d) Warm up and use correct technique, and ask if you are unsure rather than guessing. (e) Follow your healthcare professional wherever their advice conflicts with ours. (f) Not train while impaired by alcohol, medication or anything affecting coordination or judgement.

3.5 Nobody is watching. These products are performed alone and unsupervised, in a place of your choosing, with no coach present and no ability for us to observe, correct or stop you. You are responsible for the safety of your training environment and for the execution of every movement.

3.6 Emergencies. We cannot provide emergency assistance. In an emergency call your local emergency services (in Belgium and across the EU: 112).

3.7 How responsibility divides.

We are responsible for: producing content prepared with reasonable care and skill; describing exercises, progressions, criteria and warning signs accurately; telling you clearly when to stop; and telling you clearly when something needs a healthcare professional rather than a coach.

You are responsible for: deciding whether to participate; obtaining clearance; choosing your environment and equipment; executing each movement; judging your own symptoms as they happen; stopping when you should; and not progressing when you do not meet the criteria. We cannot observe, supervise, intervene in or stop any of these, and those decisions are yours alone.

3.8 Going beyond the programme. If you progress without meeting the stated criteria, add or substitute exercises, train outside the programme, or act against guidance we or your healthcare professional have given, you do so on your own initiative and at your own risk, outside what we agreed to provide.

3.9 Apportionment. Where fault on your part has contributed to an injury, responsibility falls to be apportioned under the ordinary Belgian principles of contributory fault (eigen schuld / faute de la victime), taking account of Section 3.7 and the confirmation you gave at Annex A. This allocates responsibility according to actual conduct. It does not exclude any liability that Section 8.3 says cannot be excluded.

4. THE PRODUCTS, DELIVERY AND ACCESS

4.1 What we sell here. Self-guided digital products: the Bulletproof Knee Protocol and any guide, course, ebook, download, bonus, order bump or digital upsell offered before, during or after checkout. Each has its own description and price shown before you accept it.

4.2 Delivery. Access is granted immediately or near-immediately after successful payment, to a hosted member area, account or download link. Access details go to the email address you give at checkout. Please give a correct address and check your spam and promotions folders. If nothing has arrived within 24 hours, or if anything at all is not working, email us and we will fix it — that is always the fastest way to sort a problem out.

4.3 Access duration. Lifetime access — for as long as we continue to operate the product, with no fixed end date. We may move content between platforms. If we ever permanently discontinue a product you hold, we will give you at least 60 days' notice and a fair chance to download the materials for your own use.

4.4 Improvements. We may update and improve products. We will not materially reduce what you paid for during your access period.

4.5 Availability. We cannot guarantee uninterrupted availability of our sites or of any third-party hosting or streaming service, but we will work to restore access promptly.

5. ORDERS, PRICES AND PAYMENT

5.1 How the contract forms. Your order is an offer to purchase. The contract forms when we confirm the order or grant access, whichever is earlier. You are given the chance to review and correct your details before confirming, and the order button makes clear that it carries an obligation to pay.

5.2 Confirmation. We email you confirmation of the contract, including these Terms and your acknowledgment under Annex A, before or on delivery.

5.3 Prices. Prices are shown at the point of sale, inclusive of all applicable taxes for consumers. VAT on digital products supplied to EU consumers is charged at the rate of your country of residence.

5.4 Your bank's charges. Any card fee, currency conversion cost or foreign transaction fee charged by your own provider is outside our control and is not refundable by us.

5.5 Price changes. We may change prices at any time; changes do not affect orders already placed. Where we advertise a reduction against a previous price, the reference price is the lowest price we applied in the 30 days before the reduction, as required by Article VI.18 of the Belgian Code of Economic Law.

5.6 Payment. Payment is handled by Shopify's payment infrastructure, including Shopify Payments and any wallet you choose at checkout, such as PayPal, Apple Pay or Google Pay. We never see or store your full card number. You confirm you are authorised to use the payment method you provide.

5.7 Chargebacks. If something is wrong, email us first — we resolve genuine problems quickly. Raising a chargeback without contacting us, where you are not entitled to a refund, is a breach of these Terms; we may suspend access and recover the sums due together with any chargeback fee. This does not affect your right to dispute a genuinely unauthorised transaction with your bank.

5.8 Fraud. We may cancel or refuse an order where we reasonably suspect fraud, payment abuse or repeated refund abuse. We will tell you and refund anything taken.

6. WITHDRAWAL AND REFUNDS

6.1 All sales are final

Our self-guided digital products — including the Bulletproof Knee Protocol and every ebook, guide, download, bonus, order bump and upsell — are not refundable.

You receive the complete product, in full, immediately on purchase. Nothing is held back and nothing arrives later. Once you have it, it cannot be returned and access cannot meaningfully be withdrawn — you already have the material.

So, subject to Section 6.4:

(a) all sales of self-guided digital products are final; (b) this applies separately to every upsell, order bump and bonus, each of which is its own product; (c) not having opened, downloaded or used the product is not a ground for refund; (d) changing your mind, buying by mistake, or deciding after reading it that the product is not for you are not grounds for refund.

6.2 Your statutory right of withdrawal, and how it is handled

If you are a consumer in the EU, you would normally have 14 days to withdraw from an online purchase without giving a reason, under Articles VI.47 to VI.53 of the Belgian Code of Economic Law.

For digital content supplied immediately, Article VI.53, 13° removes that right where you gave your prior express consent to immediate supply, acknowledged that you were losing the right, and were sent confirmation of both.

That is exactly what the confirmation at Annex A does. At checkout you ask for immediate access and acknowledge that you give up the 14-day right in exchange for getting the product straight away.

If you would rather keep the 14-day right, do not tick that box. Contact us instead and we will hold your access for 14 days, during which your withdrawal right survives in full. The choice is yours.

6.3 How to withdraw, where the right applies

Where you have not given the acknowledgment at Annex A, you may withdraw within 14 days of the contract being concluded by telling us clearly — by email to the address in Section 0, or using the form in Annex B. We will refund all payments received, by the same means you paid, within 14 days of being told, at no cost to you.

6.4 What Section 6.1 does not affect

Nothing in Section 6.1 limits:

(a) your statutory rights under Section 6.5 where the product is faulty, incomplete, inaccessible or materially different from how it was described; (b) any commercial guarantee we expressly offer on a specific product at the point of sale; (c) your withdrawal right where you did not give the acknowledgment at Annex A; (d) your right to a refund where we have failed to give you access to what you paid for.

6.5 If the product is not as described

Digital content supplied to consumers must conform to the contract under Book VI, Title 4 of the Belgian Code of Economic Law, implementing Directive (EU) 2019/770. If it does not — if it is faulty, incomplete, inaccessible or materially different from its description — you are entitled, free of charge, to have it put right, or failing that to a proportionate price reduction or a refund. This right runs for two years from supply and cannot be waived. To use it, email us describing the problem.

6.6 Abuse

Repeated purchase-and-refund cycles, downloading materials and immediately claiming, buying through multiple accounts, or sharing or redistributing the materials are abuse. We may refuse a claim, close the account and pursue recovery, giving our reasons in writing.

6.7 Otherwise

Except as set out in this Section 6, or where mandatory law requires, or where we have failed to deliver what was promised, fees are non-refundable.

7. YOUR LICENCE, AND OUR INTELLECTUAL PROPERTY

7.1 Ownership. All content and branding — videos, guides, PDFs, tracking sheets, criteria cards, curricula, images, copy, logos and trade marks — belongs to ASCE Performance or its licensors and is protected under Book XI of the Belgian Code of Economic Law and applicable international treaties. This includes our named methods and frameworks.

7.2 What you may do. On full payment we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the materials for your own personal, non-commercial use, for the access period stated.

7.3 What you may not do. You may not, and may not let anyone else:

(a) copy, republish, upload, post, transmit, distribute, sell, resell, licence, rent or share any of our materials; (b) share your login, or let anyone else use your account; (c) record, screen-record, screenshot, transcribe or otherwise capture our video or audio content, beyond any download function we provide for your personal use; (d) use our materials, structure or curriculum to build, teach, coach or sell a competing or derivative product or service, paid or unpaid; (e) use our materials to train, fine-tune or build any artificial intelligence model or dataset; (f) reverse-engineer any software element; (g) remove or alter any copyright or trade mark notice; (h) use our name or branding in a way that suggests endorsement or affiliation.

7.4 If you breach this. Your licence ends immediately. We reserve all rights and remedies, including injunctive relief, cessation orders under Book XVII of the Belgian Code of Economic Law, damages, and closing your account without refund.

7.5 Content you send us. If you send us feedback, a review, a question or a video, you keep ownership. You grant us a worldwide, royalty-free, non-exclusive licence to use it for the purpose of providing the service to you. We will not use your name, image, story or results in marketing without your separate, specific, written and revocable consent, obtained outside these Terms.

8. LIABILITY

8.1 What we undertake. Our obligation is one of means (inspanningsverbintenis / obligation de moyens), not of result. We undertake to apply reasonable care and skill in producing our content. We do not undertake that you will achieve any particular outcome.

8.2 Causation. Our liability arises only where harm is caused by our fault. It does not arise merely because harm occurred during or after use of our products. Given the division of responsibility in Section 3.7 — under which you alone decide whether to participate, choose your environment, execute each movement, judge your symptoms and decide whether to progress — harm arising from those decisions is not caused by us. The burden of establishing fault, causation and damage lies with the party alleging it.

8.3 What we do not and cannot exclude. Nothing in these Terms excludes or limits our liability for:

(a) death or personal injury caused by our negligence or fault; (b) fraud or fraudulent misrepresentation; (c) gross negligence (zware fout / faute lourde) or wilful misconduct; (d) anything that cannot lawfully be excluded under Belgian law, EU law, or the mandatory consumer law of your country of residence; (e) your statutory rights under Sections 6.3 and 6.5.

How to read this section: nothing in these Terms, including Sections 3.2, 3.7, 3.9 and 8.4, is intended to exclude our liability for our own fault causing personal injury, and none of it should be read that way. Those sections allocate responsibility according to what each party actually controls and does.

8.4 What we are not liable for. To the fullest extent the law allows, and subject always to Section 8.3, we are not liable for: injury or aggravation of a condition arising from your voluntary participation where it does not result from our fault; your decision to participate without or against medical clearance; your failure to stop when experiencing a warning symptom; your progression beyond the criteria we set; your execution of a movement or your choice of environment or equipment; advice given to you by anyone else; your failure to achieve a particular result; failure or outage of any third-party platform; loss of profit, data or opportunity or any indirect or consequential loss; or anything arising from your own breach of these Terms.

8.5 Cap. Subject always to Section 8.3, our total liability in connection with a contract with you is limited to the greater of the amount you actually paid under that contract in the 12 months before the event, or €500.

8.6 Severance. If any part of this Section is unenforceable where you live, that part is severed and the rest continues to the fullest extent permitted.

9. YOUR ACCOUNT AND ACCEPTABLE USE

9.1 Give accurate information and keep it current. Keep your login confidential. Your account is personal and may not be shared, transferred or sold. Tell us within 72 hours if you become aware of unauthorised access.

9.2 We may monitor for credential sharing — such as implausible concurrent sessions — and may suspend an account pending explanation, telling you why and giving you a chance to respond.

9.3 You agree not to: use our products unlawfully or fraudulently; post defamatory, harassing, hateful or infringing content; impersonate anyone; upload malware or attempt unauthorised access; scrape or harvest content; circumvent any paywall or access control; or resell any part of what we provide.

9.4 Suspension and termination. We may suspend or end your access, with reasons, where you materially breach these Terms, breach Section 7 or 9, or where the law requires. Where we end access for a serious breach by you, no refund is due, unless mandatory law says otherwise. Where we end it for our own convenience, we refund pro rata.

9.5 Reporting. If you believe content on our sites is illegal or breaches these rules, email us with enough detail to find and assess it. We handle valid reports in a timely, diligent and objective way and will tell you the outcome and our reasons. If we restrict your content or account we will give you a statement of reasons, and you may contest it by replying; we will review promptly and reverse the decision if it was wrong. This gives effect, where applicable, to Regulation (EU) 2022/2065 (Digital Services Act).

9.6 Sections that survive. Sections 2, 3, 7, 8, 10 and 11 continue to apply after your access ends.

10. COMPLAINTS AND DISPUTES

10.1 Email us — we will sort it out. If anything is wrong with your order, your access, or your experience with us, email us at the address in Section 0. We are a small team, a real person reads every message, and almost everything gets resolved this way within a few days. Please give us that chance before doing anything else — we would rather fix the problem than argue about it.

10.2 Out-of-court redress. If we cannot resolve it, consumers may contact the Belgian Consumer Mediation Service free of charge at consumerombudsman.be, or a certified dispute resolution body in their own EU country.

10.3 Courts. Under Articles 17 to 19 of Regulation (EU) 1215/2012, a consumer may bring proceedings against us in the Belgian courts or in the courts of the EU Member State where they are domiciled, and we may bring proceedings against a consumer only where they are domiciled. For business purchasers, the competent Belgian courts of the judicial district of our registered seat have exclusive jurisdiction. We do not require consumers to arbitrate. Nothing here shortens any limitation period that applies to you under mandatory law.

11. GOVERNING LAW

11.1 These Terms are governed by Belgian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

11.2 If you are a consumer habitually resident outside Belgium, Article 6 of Regulation (EC) 593/2008 (Rome I) applies: the choice of Belgian law cannot deprive you of protection given to you by rules that cannot be derogated from under the law of your country of habitual residence. Where your local law protects you more, it prevails to that extent.

12. GENERAL

12.1 Entire agreement. These Terms, the Privacy and Cookie Policy, the product description shown at the point of sale, and your order confirmation form the whole agreement between us. This does not exclude liability for fraudulent misrepresentation and does not limit your consumer rights.

12.2 Assignment. You may not transfer your rights. We may transfer ours to an affiliate or a successor business, provided your rights are not reduced; we will tell you, and if it materially affects you, you may end the agreement and receive a pro-rata refund.

12.3 No waiver. Not enforcing a provision does not waive it.

12.4 Severability. If a provision is invalid or unenforceable, it is reduced to the minimum extent needed to make it valid, or severed if it cannot be; the rest continues in force.

12.5 Notices. Notices to us go to the email address in Section 0. Notices to you go to the email on your account, and are treated as received the next working day.

12.6 Accessibility. We aim to meet applicable accessibility requirements, including Directive (EU) 2019/882 (European Accessibility Act) as transposed in Belgium. If you hit an accessibility barrier, email us and we will respond and, where we can, fix it.

ANNEX A — THE CONFIRMATION YOU GIVE AT CHECKOUT

This is the confirmation you are asked to tick before payment, reproduced here so you have a permanent record of what you agreed to. It is presented unticked and you give it deliberately.

☐ I confirm all of the following:

1. I have read and agree to the Terms of Sale and the Privacy and Cookie Policy, and I am at least 18 years old.

2. I request immediate access to the digital content and expressly consent to it being supplied before the 14-day withdrawal period expires. I acknowledge that I therefore lose my statutory right of withdrawal once access is granted. (This does not affect my rights if the product is faulty or not as described.)

3. I understand that ASCE Performance provides performance coaching — educational and physical training material only. It is not a medical, physiotherapy or healthcare provider and does not provide diagnosis, treatment or clinical rehabilitation.

4. I have obtained clearance from a licensed healthcare professional, or I have knowingly decided not to seek it, and I accept full responsibility for that decision.

5. I am not aware of any medical reason why I should not follow this programme.

6. Physical activity carries a real risk of injury — including re-injury, graft failure and aggravation of an existing condition. I am taking part voluntarily and I accept that risk.

7. I train alone and unsupervised. No coach is present. I am responsible for my environment, my equipment and my execution of every movement.

8. I will stop immediately and seek medical attention if I feel pain beyond ordinary training discomfort, giving way or instability, swelling, locking, numbness, dizziness, chest pain or shortness of breath.

9. I will not skip ahead. I will not progress to a later phase or heavier load until I meet the stated criteria, and if I do so anyway I accept that this is my own decision and my own risk.

10. If my healthcare professional's advice conflicts with this programme, I will follow my healthcare professional. I understand that no result is guaranteed.

ANNEX B — MODEL WITHDRAWAL FORM
